Terms and Conditions
The agreement between you and In The Core Athlete, Inc. when you use our website, book with us, or train at our gym.

These terms are the agreement between you and In The Core Athlete, Inc. (“In The Core,” “ITC,” “we,” “us,” or “our”) when you use traininthecore.com, book with us, buy from us, or train at our facility at 5455 Spine Road, Suite F, Boulder, Colorado.
By booking a session, buying a package, creating an account, or training with us, you agree to these terms. If you do not agree with them, please do not book or train with us.
1. The documents that govern your relationship with us
Three documents work together, and each covers something different:
- These Terms and Conditions — the general agreement covering the website, bookings, payment, conduct, and liability.
- The ITC Liability Waiver and Participation Agreement, which every participant signs before their first session — assumption of risk, health disclosure, facility rules, media release, and release of liability.
- The Purchase Terms shown at checkout when you buy a package, class pack, or gift certificate — expiration, refunds, transferability, and cancellation.
If these documents ever conflict on a specific point, the more specific document controls that point: the waiver governs participation, health, and liability; the Purchase Terms govern what you bought. These terms govern everything else.
2. Who can train with us
- You must be 18 or older to create an account, make a booking, or make a purchase.
- Athletes under 18 are welcome to train with us, but a parent or legal guardian must make the booking, complete the waiver, and be responsible for payment.
- You are responsible for keeping your account details accurate and your password private, and for anything done through your account.
3. Booking and attendance
- Classes and sessions are booked through our scheduling system. A booking is confirmed when you receive a confirmation email — not before.
- Every participant must complete the waiver before their first session. Complete it at waiver.fr/p-OtXDu, or scan the QR code in the lobby. We cannot let anyone train without it.
- Class sizes are capped, and spots are allocated in the order they are booked.
- Please arrive in time to warm up. If you arrive after a class has started, our coaches may ask you to sit it out where joining late would be unsafe.
4. Cancellation, rescheduling, and no-shows
You can cancel or reschedule any appointment or class at any time up to its start time, at no charge. There is no cancellation window to keep track of and no penalty for changing your mind.
What we do ask is that you cancel. A spot you hold is a spot nobody else can take.
- A session or class credit that is not canceled before the start time is used.
- A no-show is treated the same way: the class is used, or the session is charged.
- We may cancel or reschedule a class ourselves — for weather, coach illness, facility problems, or low enrollment. If we do, we will tell you as early as we can and your credit will not be used.
5. Packages, class credits, and expiration
- Credits expire as shown on each package at the time of purchase. Expired sessions and class credits are forfeited and cannot be extended or reinstated.
- Packages are non-transferable. They are tied to the person who bought them and may not be shared, gifted, or transferred to anyone else without our written consent.
- Class packs for our adult morning classes may be used across any of those classes unless the package says otherwise.
6. Prices and payment
- Prices are shown at the point of booking or purchase and are in US dollars.
- Payments are processed by Stripe. Your card details go directly to Stripe; we never receive or store your full card number.
- Where you keep a card on file for a package, membership, or recurring plan, you authorize us to charge that card for amounts you owe under these terms. If you cancel or replace that card, please give us the new details straight away.
- If a payment fails, we may pause your bookings until it is resolved.
- Class times, services, and prices may change. We will give notice of material changes when we reasonably can. A change never affects a package you have already bought.
7. Refunds
Packages, class credits, and intro offers are non-refundable. All sales are final.
That said, we are people, not a vending machine. If something has genuinely gone wrong — a long-term injury, a move out of state, a session we failed to deliver — contact us and we will look at it in good faith. Nothing here limits any right you have under Colorado law.
8. Recurring plans and memberships
- Recurring plans bill automatically on the schedule shown at sign-up until you cancel.
- You can cancel a recurring plan at any time, effective at the end of the current billing period. We do not pro-rate part-months.
- We will give you reasonable notice before changing the price of an existing plan.
9. Conduct and facility rules
Everyone at ITC is expected to follow the posted facility rules and the directions of our coaches. In short: appropriate athletic clothing and closed-toe shoes, use equipment only as instructed, re-rack your weights, report anything unsafe, do not train under the influence or while contagious, and treat coaches, staff, and other athletes with respect.
We may suspend or end participation, without refund, for conduct that is unsafe, disruptive, dishonest, or in breach of these rules. The full version of these rules is Section 5.6 of the waiver.
10. Health, safety, and risk
Strength and conditioning training is physically demanding and carries a real risk of injury. Those risks, the health disclosures we ask you to make, and the release you give us are set out in the waiver, which you sign separately.
Two things are worth repeating here. Our coaches are not physicians, physical therapists, psychologists, or registered dietitians, and nothing we provide is a substitute for medical care. And you must tell us about any injury, condition, medication, or change in health that affects training — before it becomes a problem.
11. Photography, video, and social media
We photograph and record training and use those images to show the work our athletes do. Consent for this is given in Section 6 of the waiver, and how we handle those images is described in our Privacy Policy. If you have a specific concern, write to us and we will work with you in good faith.
12. Your personal property
Bring what you need and keep an eye on it. We are not responsible for loss of or damage to personal property brought to the facility, except where the loss is caused by our own negligence.
13. Using this website
- You may use traininthecore.com for your own personal, non-commercial purposes: reading about us, booking, buying, and managing your account.
- You may not scrape or harvest the site, attempt to gain unauthorized access to any part of it, interfere with its operation, upload anything malicious, impersonate anyone, or use it in a way that breaks the law.
- Any content you submit to us through this site must be your own and must not be abusive, defamatory, or unlawful. We may remove anything at our discretion.
- We may suspend or close an account that is used in breach of these terms.
14. Our content
The text, photographs, video, logos, program names, training material, and design on this site belong to In The Core Athlete, Inc. or to the people we license them from, and are protected by copyright and trademark law. You may read and share links to our pages. You may not copy, republish, or use our content commercially without our written permission.
If you send us feedback or a suggestion, we are free to use it without owing you anything for it.
15. Links to other sites
Our site links to our scheduling provider, our waiver provider, our payment pages, and our social media accounts. Those are other companies’ sites, with their own terms and privacy policies. We are not responsible for their content or their practices.
16. Accuracy
We work hard to keep schedules, descriptions, and prices on this site correct, and our scheduling system is the source of truth for class times and prices. If something on the site is wrong or out of date, we may correct it, and we may cancel a booking or an order that was placed at an obviously incorrect price. If we do, you get a full refund of anything you paid for it.
17. Disclaimers
The website and its content are provided “as is.” We do not warrant that the site will be uninterrupted or error-free, or that any particular training outcome will be achieved. Results depend on many things we do not control, including consistency, sleep, nutrition, and health.
18. Limitation of liability
To the fullest extent permitted by Colorado law, In The Core Athlete, Inc., its owners, coaches, staff, and contractors are not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising out of your use of this website or our services. Our total liability for any claim relating to these terms is limited to the amount you paid us in the twelve months before the claim arose.
Nothing in this section limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence to the extent Colorado law prohibits its exclusion. The release you sign in the waiver governs claims relating to participation and injury.
19. Indemnity
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms, your misuse of the website, or your violation of the law or of anyone else’s rights.
20. Governing law and disputes
These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Boulder County, Colorado, and you and we each consent to that venue.
Before filing anything, please talk to us. Most problems are faster to fix by email than in a courtroom.
21. General
- If any part of these terms is found unenforceable, the rest stays in force.
- If we do not enforce a term straight away, we have not given up the right to enforce it later.
- You may not assign your rights under these terms. We may assign ours if the business is sold or reorganized.
- These terms, together with the waiver and the Purchase Terms, are the entire agreement between us.
22. Changes to these terms
We will update these terms as the business changes. The effective date at the top tells you which version you are reading. If a change is material, we will say so on this page, and continuing to book or train with us after that means you accept the updated terms.
